Best way to check this is to push up and down on the volume buttons.

If it does think the headphones are in, most likely cause was liquid in the headphone jack. You can turn the phone off and clean the headphone jack with a blast of compressed air and a Q-tip with 90% rubbing alcohol.

If this doesn't correct it, you'll need to replace the headphone and volume control cable, which includes a new headphone jack. This is a very time-consuming and tedious repair. It's not for the faint of heart. But the parts are cheap. If you want to see a walk through for the repair, try IFixit.com. Go in ASAP and plead a good case. Meaning one in equity and not one in law.
